Terms & Conditions

Definitions
Please find below the conditions that outline the rights, responsibilities and obligations of all parties involved in this agreement; where ‘you’ and ‘your’ speak of the customer, ‘we’, ‘us’ and ‘our’ refer to the Jade Gardening and ‘team’, ’providers’ signify the third party subcontractors who help with the services. These terms and conditions are susceptible to change without prior notice.
Please read these terms and conditions. They set out the legal rights and obligations in relation to the services of Jade Gardening. By accepting the quotes, paying deposits required and works starting, you, the client, have deemed to accept all of the terms and conditions listed below. Nothing in these Terms and Conditions affect the clients’ statutory rights as a consumer.1. Services Provided
1.1. We provide a regular basic general garden maintenance service which consists of mowing, weeding, edging and pruning, pressure washing on our basic rate
1.2. A one-off garden visit at a rate we will confirm on quoting
1.3. We provide hedge trimming, tree pruning up to 15ft, soft landscaping, plant and garden designs, plant list and mood boards on a rate that we will confirm on quoting
1.4. Any hard landscaping is not included and would require a separate contractor
1.5. Removal of waste is not included and would require a separate contractor
1.6. Initial maintenance consultations are free of charge
1.7. Design consultations are £50 for an hour
1.8. Only the work agreed to is included
2. Payment and Invoicing
2.1. Regular maintenance work would be invoiced either via email or text after each visit. Full payment is due within 3 days. Balances remaining after this period are charged with interest at 2.5% above base rate, calculated and added on to the next invoice.
2.2. Payment can be made by or bank transfer, paid in cash or by card providing internet access is available
2.3. Card payments require a 2% extra charge to cover the fee
2.4. A deposit may be required for supplies. For landscaping work regular staged payments may be specified, a payment schedule will be provided before work starts.
2.5. Any time spent on the garden including planning, designing, collection of supplies is subject to our hourly rate based on service
2.6. Any estimates are valid for 2 weeks. Any alterations, modifications or extras beyond the work agreed to, is liable to additional cost, which will be agreed by you and Jade Gardening, prior to works being undertaken
2.7. If you are having a design service, a non-refundable advance payment of 20% the estimated price may be required to secure the booking
2.8. If work has commenced, any services stopped due to the client(s) or visitors of the client being disrespectful, abusive or threatening will be charged the full quote of the work
2.9. In any event that it is required to institute legal recovery of any outstanding money owed, the client will be liable to pay for Jade Gardening’s legal fees in full
3. Scheduling and Cancellations
3.1. All work must be confirmed either via email, text message or writing
3.2. Jade Gardening will require written confirmation via email, text message or writing that you have accept any estimates or quotes and these terms and conditions
3.3. Works progress is subject to prompt payments. Late or incorrect payments will result in cessation of work and would cause possible delays to schedules.
3.4. Garden maintenance visits must be cancelled no later than 48 hours beforehand. If works are cancelled within the 48 hours of planned work, a non-attendance fee of £40 will be charged without notice
3.5. If unforeseen circumstances prevent me from delivering the agreed services, I will inform you as soon as possible. This includes severe weather, illness, childcare needs, supply chain disruptions etc.
3.6. In the event the client cancels the gardening service upon our arrival, the full labour cost for the visit will be charged
3.7. In the event we are unable to safely gain access, Jade Gardening reserves the right to charge 100% of the labour costs of the planned visit
3.8. If the client decides that they do not require the service for a period of time, for example over the winter months or the client is traveling, the regular slot you have will not be held without a pay for access retainer fee. If a retainer fee is not specified, then we cannot guarantee the regular slot and/or any availability when the client wishes to resume
4. Client Responsibility
4.1. It is the client’s responsibility to make sure that Jade Garden are fully aware of the service that the clients want. Any changes must be given in writing
4.2. It is the client’s responsibility to look after plants and lawn turf supplied once installed. Losses due to lack of care or watering will not be replaced free of charge and any replacements needed must be paid for in full
4.3. It is the responsibility of the client to allow adequate access to the site
4.4. It is the customers responsibility to ensure that dog poo is cleared before we arrive. If dog poo does pose a hazard to us, we reserve the right to cancel at the site and charge a cancellation fee equal to the work
4.5. The client is to indicate the line of boundaries, underground cables and pipes before work commences
4.6. The client is responsible for providing accurate and complete site information, including details about access, boundaries and existing features
4.7. The client is responsible for gaining any requirements for planning permission or tree preservation orders
4.8. It is the client’s responsibility to inform us of any changes to the site or any issues that occur as soon as possible
4.9. The client accepts that they will pay the required invoice within 3 days
4.10. As a result of the client’s change of mind in materials or supplies that have already been ordered or delivered, the client will be solely responsible for the costs and any additional costs that occur
4.11. It is the client’s responsibility to ensure there is parking arrangements provided, including parking permits or suspensions with your district council. Any parking fees or fines accrued during the time of works and services provided, are to be paid by the client
5. Rights and Reserves
5.1. Jade Gardening will not be held responsible for any delays, fines or costs resulting from missing site information or incorrect permissions
5.2. Jade Gardening reserves the right to refuse or stop the services being provided at any time, if any of the staff members are being disrespected, threatened or abused in any way by the client or visitors of the client
5.3. Jade Gardening reserves the right to stop work in the progress due to illness, childcare or adverse weather conditions
5.4. Jade Gardening reserves the right to engage sub-contractors should the project require them
5.5. We will agree on a date and time for works to commence and will endeavour to ensure this is accurate. However, we accept no liability for late attendance or non-attendance, or for late or non-delivery of supplies
5.6. Any dates and times given are approximate dates and times and Jade Gardening will not be in breach of this agreement for failing to start or finish at any given date.
5.7. Jade Gardening is not liable for unavoidable or unforeseeable damage that occurs because of works carried out
5.8. Jade Gardening is not liable for any loss of nature which is not caused by our negligence or a breach of the terms and conditions
5.9. Any accidental or malicious damage caused by the client or third party during any works may incur an additional repair charge
5.10. We cannot accept responsibility for damage to statutory services (such as gas/ water/ electricity supplies) if notification of their locations is not given prior to work commencing
5.11. Jade Gardening will research and take the advice of the supplier as to the way to use the supplies and/or materials. Jade Gardening accepts no responsibility if there are any problems with the product and the supplier’s advice has been taken, unless it has been wrongly installed or planted
5.12. Any materials, tools or plants delivered to the site become the responsibility of the client. Jade Gardening accepts no responsibility for loss, damage or expense after delivery of materials to site for any reason
6. Liability and Disputes
6.1. Jade Gardening accepts no liability whatsoever for any losses or future disputes which the client may have with the owner(s) of neighbouring properties or other parties as a result of works carried out on or within the boundaries
6.2. In the event of a dispute, Jade Gardening aims to resolve matters directly, in a fair and timely manner. If we cannot agree, we may explore mediation or other alternative dispute resolution methods before considering legal action
6.3. After practical substantial completion, we cannot accept responsibility for any damage from the elements, including drought, winds, rain and frost to any material(s) including plants and lawn turf
6.4. Where any works that are passed over to other contractors or services, Jade Gardening is not responsible for any works, damage or changes to plans, carried out by the third-party contractors
6.5. Jade Gardening has public liability insurance
7. Copyright and Intellectual Property
7.1. All design work including, drawings, designs, plans and related materials prepared by myself, remain my intellectual property. Once payment is received you are granted a license to use the designs for the specific project at the agreed site
7.2. Designs and related materials must not be reproduced, altered, or transferred to third parties without my written permission
7.3. Jade Gardening may take photos of your garden and use them for promotional purposes. At the onset of works this is agreed to, unless you otherwise inform me in writing
8. Customer Care Policy
8.1. Jade Gardening is proud of the value, quality and dependability of the services it provides
8.2. If the client is not fully satisfied with the service, then please inform us in writing
8.3. We will always be professional and courteous when interacting with our clients
8.4. We will respond to client inquires and requests as soon as possible
8.5. We will keep our clients informed of any changes and updates that might affect them
8.6. We will take the time to understand the client’s needs and expectations
8.7. We will be clear and honest in our communication with the client
8.8. We endeavour to keep our service as flexible to the client’s needs, so long as the terms and conditions are adhered to
9. Miscellaneous
9.1. Access to water and electricity will be provided by the client at no extra cost to Jade Gardening
9.2. Any plants that are delivered by me, if not planted immediately, will be stored in an agreed location within the client’s property
9.3. Jade Gardening uses reputable suppliers for all supplies
9.4. All supplies will have a 15% mark up on cost to cover sourcing, quoting and research time
9.5. Natural products may show some colour, texture or spatial variations and Jade Gardening accepts no responsibility for any supplies that are not exact representations of samples provided
9.6. Jade Gardening will not be held responsible for the fading of colours due to efflorescence, which is a natural condition on concrete products
9.7. Jade Gardening will not be held responsible for any changes that happen to any wood products. Weather conditions will cause a reaction, and certain conditions will cause products to split, lose shape, move or warp
9.8. Certain materials such as terracotta, natural stone and other paving can be affected and/damaged by extreme weather conditions. The client should take the necessary precautions to prevent this and Jade Gardening will not be held responsible for any damages that do occur
